1. Acceptance of Terms

By accessing, registering an account, or transacting on the GhumYatra platform, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not access or use the platform. We reserve the right to modify these Terms at any time, and your continued use of the platform constitutes acceptance of updated Terms.

2. Our Marketplace Role

GhumYatra provides an online marketplace platform that enables registered users ("Hosts") to publish listings of accommodation properties ("Listings") and interact/book stays directly with travelers ("Guests").

GhumYatra does not own, manage, create, sell, or resell any Listings. When Guests complete a booking, they are entering into a direct contract with the Host. GhumYatra acts solely as a payment collection agent and facilitator of communication and is not a party to the contract between Host and Guest.

3. Guest Terms & Bookings

When booking a Listing, you agree to pay the accommodation rate, service fees, applicable taxes, and any extra security deposits specified at checkout.

• Booking Confirmation: A booking is officially confirmed when you receive confirmation through the platform and the escrow payment is successfully processed.
• Accommodation Rules: Guests are responsible for following house rules set by the Host, treating properties with care, and leaving stays in clean condition. Any damage caused during a stay must be resolved directly with the Host or under our damage reporting channels.
• Guest Occupancy: You agree not to exceed the maximum occupancy stated on the confirmed Listing without the Host's explicit prior approval.

4. Host Terms & Listings

As a Host, you are solely responsible for your Listings. You must provide complete and accurate information regarding pricing, description, availability, safety protocols, and house rules.

• Listing Integrity: Photos uploaded must accurately reflect the current physical state of the property. Listing deceptive or inaccurate descriptions is strictly prohibited and can result in Listing removal or account termination.
• Compliance & Permits: Hosts warrant that they hold all local authority permits, business licenses, and tax registrations required to operate a lodging establishment under the laws of Nepal.

5. Payments, Fees & Taxes

All payment transactions must be processed through GhumYatra's authorized checkout channels (including credit cards, eSewa, Khalti, or bank transfers). Offline or cash-in-hand transactions to circumvent fees are strictly prohibited.

• Service Fees: GhumYatra charges a standard platform charge (typically 10%) on verified bookings to cover digital infrastructure maintenance, payments, and support operations.
• Payout Timeline: Host payouts are processed and dispatched within 24 hours after the guest's verified check-in time.
• Tax Responsibility: Hosts are responsible for declaring and paying all applicable local taxes, municipal tourism levies, and Value Added Tax (VAT) associated with their earnings.

6. Cancellations & Refunds

Cancellation terms are governed by the policy selected by the Host and clearly shown on the Listing detail page and during the reservation checkout process.

• Refund Escrow Policy: In the event of a cancellation, eligible refund amounts will be calculated and returned to the Guest's original payment method in compliance with the cancellation policy timeline.
• Host Cancellations: If a Host cancels a confirmed reservation, the Guest will automatically receive a full refund, and the Host may face cancellation penalties or profile downgrades.

7. User Conduct & Content

You agree to use GhumYatra in good faith. You are prohibited from harvesting user data, posting malicious links, distributing copyright-infringing content, or uploading abusive or fraudulent reviews.

GhumYatra reserves the right to review, edit, or delete any content (including listing text and review commentary) that we determine, in our sole discretion, violates our community guidelines.

8. Indemnification & Liability

You agree to indemnify, defend, and hold harmless GhumYatra, its parent companies, and its employees from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your breach of these Terms or your interactions/stay with any Guest or Host.

GhumYatra is not liable for any personal injury, property damage, loss of profits, or indirect damages resulting from bookings made on the platform. All bookings are made at the user's independent risk.

9. Governing Law & Disputes

These Terms are governed by the laws of Nepal. Any legal action, dispute, or claim arising out of these Terms or the use of the platform shall be submitted to the exclusive jurisdiction of the competent courts in Kathmandu, Nepal.
